The court validated the inclusion of a voter's name in the electoral roll, affirming electoral rights.

JUDGMENT

The above writ petition is filed with following prayers i. “Issue a writ of certiorari calling for the records leading to Exhibit P7 to the extent it includes the name of the petitioner in the supplementary voters list of the voters whose names were removed from the electoral roll of ward no 21 in Valiamaram ward in Alappuzha Municipality;

ii. Issue a writ of mandamus directing the 5th respondent to consider and dispose of Exhibit P9 appeal forthwith, and consequently to include the name of the petitioner in the voters list of Ward No. 21 (erstwhile Ward No. 16) in part 1 of Valiamaram in Alappuzha Municipality therein;

iii. Issue a writ in the nature of declaration that the action of the 2nd and 3rd respondents in recommending the deletion of the petitioner’s name from the voters’ list is nothing but an abuse of statutory power and a subversion of the democratic process, thereby disentitling the 2nd and 3rd respondents from continuing to hold their offices;

iv. Issue a writ of mandamus or any other appropriate writ, order or direction directing the 2nd respondents to forthwith restore and include the petitioner’s name in the voters’ list of Ward No. 21 (erstwhile Ward No. 16), Part 1 of Valiamaram, Alappuzha Municipality, on the basis of her permanent residence, and to permit the petitioner to exercise all consequential rights in the forthcoming election;

v. To declare that the petitioner is entitled to be included in the voters list of Ward No. 21 (erstwhile Ward No. 16) in part 1 of Valiamaram in Alappuzha Municipality on the basis of her permanent residence at building No. TC No. 27/884/A;

vi. Dispense with the filing of English translations of vernacular documents;

vii. Grant such other reliefs as this Court deems fit in the facts and circumstances of the case.” [sic]

2. When this writ petition came up for consideration on 18.11.2025, this Court passed the following order :

“The 5th respondent is directed to consider Exhibit P9 appeal filed by the petitioner by 19/11/2025 itself, after giving an opportunity of hearing to the petitioner and the 4th respondent. The petitioner will appear before the 5th respondent on

19/11/2025 at 10 a.m.

Post on 20/11/2025.

The Special Government Pleader and the Standing Counsel for the Election Commission will communicate this order to the 5th respondent.”

3. Today, the Standing Counsel appearing for the Election Commission submitted that as per the order bearing No.DCALP/11484/2025/M2 dated 19.11.2025, the appeal filed by the petitioner is allowed and her name will be included in the electoral roll. If that is the case, no further direction is necessary.

Recording the above submission, this writ petition is disposed of.
