O R D E R
This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 .
2. The petitioner is the sole accused in Crime No.595/2024 of Kanakakkunu Police Station. The offences alleged against the petitioner are punishable under Sections 332(b), 309(6), 351(3), 64(1), 127(2), 238(b) and 324(3) of Bharatiya Nyaya Sanhita, 2023 (BNS).
3. The prosecution case as narrated in Annexure A2 order reads thus :-
“ On 24.08.2024 at 10 p.m the accused trespassed into the house of CW1 situated at Kandalloor south in Puthuppally village, with an intention to commit robbery and rape on CW1. It is alleged that the accused robbed 7 sovereigns of gold of CW1. It is alleged that the accused robbed 7 sovereigns of gold from CW1 and committed rape on her. He also intimidated to kill her.
