This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023 seeking regular bail.
2. The applicant is the sole accused in Crime No.127/2025 of Nadapuram Excise Range, Kozhikode District. The offences alleged are punishable under Sections 55 (a) and
58 of the Kerala Abkari Act .
3. The prosecution case, in short, is that on
11.11.2025 at 07:30 p.m., at road margin of the State Highway Peringathoor - Nadapuram road at Kayappanichi, the applicant was found in possession of 30 litres of Indian Made Foreign Liquor, for the purpose of sale, in contravention of the Abkari Act and Rules and thereby committed the offences.
4. I have heard Sri. Priyesh Kumar M.P., the learned counsel for the applicant and Smt. M.K. Pushpalatha, the learned Senior Public Prosecutor. Perused the case diary.
5. The learned counsel for the applicant submitted that the applicant is innocent and has been falsely implicated in the present case. The counsel further submitted that no materials are on record to connect the applicant with the alleged crime; hence, he is entitled to get bail.
