We have heard Smt. Sayujya Radhakrishnan, the learned Amicus Curiae appearing for the Special Commissioner, the learned Standing Counsel for the Travancore Devaswom Board, and the learned Government Pleader.

2. One of the grievances highlighted before us is that the Legal Squad of the Legal Metrology Department, which conducts inspections along with the Duty Magistrate at Sannidhanam, has declined to impose fines even in cases where stalls were found to be violating the provisions of the Legal Metrology Act , 2009.

3. Today, when the matter was taken up, a communication issued by the Additional District Magistrate, Sabarimala, addressed to the Executive Magistrate and the Legal Metrology Officer, was placed before this Court. In the said communication, categorical directions have been issued to carry out seizure, search, and prosecution strictly in accordance with the provisions of the Legal Metrology Act , 2009, as clarified by the Hon’ble Apex Court in ITC Ltd v. State of Karnataka 1 .
