IN THE HIGH COURT OF KERALA AT ERNAKULAM
DR. KAUSER EDAPPAGATH, J
DEEPAK T.R – Appellant
Versus
ASHMA – Respondent
J U D G M E N T
The petitioner suffered ex-parte order in M.C.No. 225 of
2023 pending on the files of the Family Court, Attingal. He filed Ext.P3 petition to set aside the ex-parte order. It is still pending as evident from Ext.P5 copy of the proceedings sheet. The limited prayer of the petitioner is to give a direction to the Family Court, Attingal, to dispose of Ext.P3 petition.
2. Considering the nature of the order going to be passed, I am of the view that notice need not be issued to the respondents.
3. It is submitted that connected matters between the same parties are pending before the same Family Court, in which already there is a direction to dispose of the same within a time frame. Hence, there will be a direction to the Family Court, Attingal, to dispose of Ext.P3 petition within a period of one month from the date of receipt of a copy of this judgment.
The original petition is disposed of as above.
