IN THE HIGH COURT OF KERALA AT ERNAKULAM
DEVAN RAMACHANDRAN, M.B. SNEHALATHA, JJ
SURYA SUPRY KALAPPURAKKAL CYPRIAN – Appellant
Versus
GINNU THOMAS – Respondent
ORDER Devan Ramachandran, J.
The petitioner seeks the review of the judgment of this Court dated 01.08.2025 in OP(FC)No.417/2025, asserting that none of the observations therein, or the terms of the Agreement between the parties in it - based on which such judgment had been delivered - are binding on her.
2. Admittedly, the Original Petition in question was filed initially with the petitioner herein on the party array as respondent No.1. Pending the Original Petition, the petitioner herein and original respondents 2 and 3 agreed to a compromise, based on which, the judgment of this Court was delivered. One of the terms of the compromise is that the parties have no objection to deleting the petitioner herein from the party array;
and it was so done, based on such consent.
3. The petitioner, however, now says that she is not happy with the compromise and that she does not want to be bound by it.
4. Obviously, nothing contained in the judgment or in the compromise - based on which we had acted - would apply to the petitioner, since she was not a party therein; and consequently, she would be at liberty to invoke any remedy that may be available to her.
