O R D E R
This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short, ‘ BNSS ’).
2. The petitioner is accused No.1 in Crime No.1163/2025 of Sulthan Bathery Police Station. The offences alleged against the petitioner are punishable under Sections 22 (b) and 29 of the Narcotic Drugs and Psychotropic Substances Act , 1985 (for short 'the NDPS' Act').
3. The prosecution case is that on 20.08.2025 at about
11:45 am, the accused No.1 was found in possession of, and transporting, 19.38 grams of methamphetamine.
4. The petitioner was arrested on 20.08.2025 and he has been in judicial custody since then.
5. Heard the learned counsel for the petitioner and the learned Public Prosecutor.
6. The learned counsel for the petitioner submitted that the investigation is practically over and further detention of the petitioner is not required.
7. The learned Public Prosecutor opposed the bail plea of the petitioner
8. Having regard to the nature of the allegations, stage of the investigation and the tenure of judicial custody undergone by the petitioner, I am of the view that the petitioner is entitled to be released on bail on conditions.
