The parties have settled their disputes in mediation. They have entered into a memorandum of settlement incorporating the terms.

2. The 11th respondent is presently abroad. She has sent a letter dated 20.10.2025 addressed to the Registrar of this Court accepting the compromise entered into in mediation. A copy of the passport has also been enclosed therewith. The first appellant has sworn to an affidavit swearing that the interest of the 11th respondent are not affected by the settlement. In the light of the above the mediated settlement is accepted.

3. The decree and judgment of the trial court are set aside.

A modified decree is passed in terms of the settlement. The memorandum of settlement along with the plan appended thereto R.F.A. No.111 of 2022 will form part of the judgment.

Registry to send a copy of this judgment along with the plan appended thereto to the 11th respondent in the address shown in the letter sent by her to the Registrar of this Court.

The appeal is disposed of as above.
