The petitioner, who is the 1st defendant in W.O.S.No.69 of
2024 on the file of the Waqf Tribunal, Kozhikode, has filed this original petition invoking the supervisory jurisdiction of this Court under Article 227 of the Constitution of India, challenging Ext.P10 order dated 13.11.2025 of the Tribunal in I.A.No.2 of
2025 in that suit.
2. On 24.11.2025, when this original petition came up for admission, after arguing for some time, the learned counsel for the petitioner sought a short adjournment to address arguments on the question as to whether an MFA (Waqf) has to be filed challenging the order dated 13.11.2025 of the Waqf Tribunal.
3. In view of sub-section (9) of Section 83 substituted by the Waqf (Amendment) Act, 2025, any person aggrieved by the order of the Tribunal, may appeal to the High Court within a period of ninety days from the date of receipt of the order of the Tribunal.
4. The learned counsel for the petitioner seeks permission to withdraw this original petition, without prejudice to the right of the petitioner to file an MFA (Waqf), challenging Ext.P10 order dated 13.11.2025 of the Waqf Tribunal in I.A.No.2 of 2025 in W.O.S.No.69 of 2024.
