O R D E R Dated this the 26th day of November 2025 The Criminal Miscellaneous Case is filed to quash all further proceedings in L.P.No.26/2014 on the file of Court of the Judicial First Class Magistrate Court-II, Thamarassery (Trial Court), which has been committed to the Court of Session, Kozhikode and has arisen from Crime No.266/2011 registered by the Mukkom Police Station.

2. The petitioner, who is the 8th accused, has filed the Crl.M.C on the assertion that the other accused persons have been honourably acquitted as per Annexure- 2 judgment. Therefore, no fruitful purpose would be served by continuing the prosecution against the petitioner.

3. When the Crl.M.C. came up for consideration on

21.10.2025, this Court had directed the petitioner to surrender before the Trial Court and get himself enlarged on bail, since the case has been pending in the Long Pending Register since 2014 onwards.

4. Heard.

5. Despite the above order, the petitioner has not got himself enlarged on bail. In view of the fact that the petitioner has failed to surrender before the Trial Court, I am not inclined to exercise the inherent powers of this Court to quash further proceedings in the above crime.
