This original petition has been filed challenging the interim maintenance ordered under Section 144 (1) proviso of the Bharatiya Nagarik Suraksha Sanhita , 2023.
2. The petitioner is the husband of the respondent.
The respondent filed M.C.No. 85 of 2025 before the Family Court, Palakkad, claiming maintenance. The respondent had also filed Crl.MP No. 400 of 2025 claiming interim maintenance. The Family Court granted interim maintenance at the rate of Rs.7,500/- (Rupees Seven Thousand Five Hundred only) per month.
3. I have heard the learned counsel for the petitioner.
4. Admittedly, the petitioner is working as a Senior Test Engineer at INAAP, Ernakulam. It was admitted that he is earning Rs.58,000/- per month. According to the petitioner, the respondent is a practising lawyer. However, there is absolutely nothing on record to prove the same. The respondent has asserted that she has no job or income.
In these circumstances, the monthly interim maintenance of Rs.7,500/- granted by the Family Court, Palakkad, appears to be very reasonable. There is no illegality or impropriety in the impugned order. Accordingly, this original petition is dismissed.
