JUDGMENT
Dated this the 05th day of November, 2025 The issue involved in the present writ petition stands covered by the decision rendered in W.P.(C) No. 18495 of 2019.
2. The petitioner contend that the Government issued the orders with prospective effect in order to exclude teachers appointed after 01.04.2013, from the statutory pension scheme and to include them in the contributory pension scheme.
3. It is further contended that this issue has already been considered by this Court in various writ petitions, wherein directions were issued to approve the appointments with effect from the petitioners' original date of appointment. In this regard, the petitioner produced the judgment in W.P(C) No.18495 of 2019. Therein, this Court considered a similar issue in light of the judgment dated 19.09.2014, in WP(C) No.20849 of 2013, which directed granting the benefit of upgradation from the start of the academic year, after physical verification of the number of periods.
4. The appeal against the judgment was dismissed by the judgment in W.A.No.724 of 2015 dated 28.02.2019. Despite this, the direction in the judgment dated 19.09.2014 in W.P(C) No.20849 of 2013 was not complied with, based
