JUDGMENT [Mat.Appeal Nos.154/2024, 257/2024]

The appellant assails the judgment and decree of the learned Family Court, Chavara in O.P.(Others) No.755/2016 and the counterclaim therein, asserting it to be illegal and unlawful.
2. A brief look at the essential facts involved in this case will be necessary, to avoid confusion as we go forward.
3. Respondents 1 and 2 – namely Smt.Gracykutty and Sri.Yesudhasan, are husband and wife; and the appellant – Smt.Marykutty is the sister of Sri.Yesudhasan, thus being the sister- in-law of Smt.Gracykutty. The parties will hereinafter referred to by their names to avoid any chance of ambiguity.
4. Smt.Gracykutty says that she purchased 4.05 Ares of land using her patrimony from her late mother-in-law – Smt.Thressia, through Ext.A3 S
