The applicant in T.A.No.4916 of 2012 on the file of the Kerala Administrative Tribunal, Additional Bench at Ernakulam (the ‘Tribunal’, in short) filed this original petition invoking the supervisory jurisdiction of this court under Article 227 of the Constitution of India , challenging the order dated 19.02.2019 passed by the Tribunal along with connected original applications.
2. The T.A. was originally filed before this Court as a writ petition under Article 226 of the Constitution of India, which was numbered as W.P.(C)No.12682 of 2008 and was transferred to the Tribunal, on the formation of the same. In the writ petition, which was later numbered as T.A.No.4916 of 2012, the petitioner-applicant sought the following reliefs:
“(i) Issue a Writ of Certiorari or any other appropriate writ or order or direction, calling for the records leading to issue of Exts.P5 and P6 and quash the same.
(ii) Issue a Writ of Mandamus or any other appropriate writ or order of direction commanding the second respondent to grant notional promotion to the petitioner to the post of Assistant Excise Inspector from the date on which his immediate juniors were promoted.
