IN THE HIGH COURT OF KERALA AT ERNAKULAM
MOHAMMED NIAS C.P., J
FIROZ EDAVALATH – Appellant
Versus
UNION OF INDIA – Respondent
WP(C) NO. 41194 OF 2025
For the Appellants/Petitioners: SHRI.S.NITHIN (ANCHAL), SHRI.HARIKRISHNAN M.S.
For the Respondents: ADV.O.M.SHALINA, SRI. V. GIRISH KUMAR
The Court directed the renewal of a valid passport when no criminal charges are present, showing that mere caution entries cannot indefinitely halt such renewal.
Headnote:The petitioner, holder of a valid Indian Passport, sought renewal which was denied due to a caution entry based on Customs' objection. The Court noted no criminal charges against the petitioner; the Customs had no objection for renewal. Ultimately, the Court directed the second respondent to renew the passport within three weeks if the application is otherwise in order. The Writ petition is disposed of as above.

JUDGMENT
The petitioner is the holder of an Indian Passport bearing No. C5574630, which is valid till 30.12.2025. The petitioner had applied for renewal of the passport, which was not considered based on a caution entry.
2. Learned DSGI submits that it was solely based on the objection of the Customs that the passport was not renewed. 3. Learned counsel for the petitioner points out that there was no criminal case registered against him, but only adjudication proceedings as seen from Ext.P2.
4. Learned Standing Counsel for the 3rd respondent, Customs, submitted before me that they have no objection to the passport of the petitioner being renewed. This is recorded.
5. Accordingly, there will be a direction to the 2nd respondent to re-issue/renew the passport of the petitioner, if the application is otherwise in order, within three weeks from the date of receipt of a copy of this judgment.
The Writ petition is disposed of as above.
