JUDGMENT
The petitioner has approached this Court seeking the following reliefs:
i) Declare that respondents have no authority to impose penalty on the petitioner for stoppage of work from 01.10.2021 to 15.10.2021 in respect of Exts.P1 and P2 works.
ii) Issue a Writ of mandamus or any other Writ, Order or direction directing the 2nd and 3rd respondents to pay an amount of Rs.29,56,041/- due to the petitioner by way of bill amount due in respect of work done as per Exts. P1 and P2 agreements and iii) Pass such other orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case.
2. It is averred that the 3rd respondent invited tenders from duly qualified persons for carrying out the work of 'Cleaning and Lubrication of Interlock Point Chairs under the Jurisdiction of ADSTE/ERS Section'. Pursuant to the notification, petitioner participated in the tender and it was confirmed in the name of the petitioner. The total agreement value of the contract is Rs.69,49,800/-. Consequentl
