1 The purported surrender of the Sherthallai Cooperative Union High School, Pattanakkad to the State has given rise these original petitions. The petitioner in O. P. No. 1671 of 1978 is the senior most High School Assistant of the School. The Headmaster of the School was to retire on 31-5-1978. The 2nd respondent Director of Public Instruction by Ext. P13 proceedings dated 18-5-1978 transferred and posted one E. N. Sankaran Nair as Headmaster of the school. The petitioner's case is that the petitioner was to be promoted and posted as Headmaster of the school. So, the petitioner challenged the above posting of Sankaran Nair as Headmaster by this original petition. A relief by way of a declaration that the purported surrender of the School to the State is invalid and not binding on the petitioner and the staff is also among the other reliefs claimed in the original petition.

2 The facts which led to Ext. P13 proceedings are: The Sherthallai Cooperative Union High School was established and run by the Taluk Sahakarana Sangham No. 1052. The petitioner was the First Assistant of the School. With the commencement of the Kerala Cooperative Societies Act, 1969 Taluk Cooperative Unions cease
