1. The petitioner is represented by a power of attorney holder. The petitioner is the owner of apartments 8E and 8F in Jomer Avalon Apartment. The petitioner is based in Dubai and hence is represented by his power of attorney. The 4th respondent claims to be the president of the 5th respondent Association and the 6th respondent is the secretary. The flat originally belonged to the petitioner's father and he filed O.S. No.126 of 2020 before the Munsiff's Court - IV, Ernakulam, in which respondents 4 and 5 are respondents. The said case is filed to declare that the decision of the meeting of the managing committee of the 5th respondent is not valid from 20.07.2018.
2. The case of the petitioner is that during February 2021, respondents 4 and 7 committed theft of a Marine aquarium and other articles owned by the petitioner, and on a complaint, they were arrayed as accused Nos.1 and 2 in C.C.No.202 of 2022 on the file of the Judicial First - Class Magistrate Court - II, Ernakulam, and the final report is filed on 23
