Headnote:The Crl.M.C. was filed to quash an FIR under Crime No.99/2022 by the Parassala Police. The Public Prosecutor confirmed that the Investigating Officer submitted the Final Report to the Magistrate. The court dismissed the Crl.M.C but allowed the petitioner to challenge the Final Report. The petitioner retains the right to seek discharge if the charges are not framed.

ORDER

The Crl.M.C. is filed to quash Annexure-A1 FIR in Crime No.99/2022 registered by the Parassala Police Station.

2. The learned Public Prosecutor, on instructions, submits that the Investigating Officer has already laid the Final Report before the Court of the Judicial First Class Magistrate-II, Neyyattinkara on 30.01.2022.

In light of the above submission, this Crl.M.C. is dismissed, but by reserving the right of the the petitioner to challenge the Final Report or to file an application for discharge before the Jurisdictional Court, provided the charge has not been framed till date.
