A police clearance certificate must be issued based on a court order, even if the applicant is involved in a criminal case.

Headnote:The judgment relates to the issuance of a Police Clearance Certificate (PCC) to the petitioner, SANISHA SELESTIN, who is involved in a criminal case. The court highlights the necessity for a Customised PCC upon the respondent's refusal to grant the standard PCC. The ruling mandates the issuance of a Customised PCC, reflecting the criminal case details, within two weeks from receipt of this judgment. The issue framed by the court revolves around the legality of the respondent's refusal to issue the PCC. The court’s ratio decidendi affirms that despite pending criminal allegations, the petitioner is entitled to a PCC, conditioned on this ruling. Accordingly, the court disposes of the writ petition directing compliance with the terms set forth.

The petitioner is aggrieved as the 1st respondent has not considered her request for a Police Clearance Certificate (PCC)

favourably.

2. The learned DSGI appearing for the respondents would submit that the petitioner is involved in a criminal case and therefore, only a Customised PCC can be issued, and that too only on orders from this Court.
