O R D E R Dated this the 15th day of December, 2025 The petitioner in MC.No.138/2009 on the file of Judicial First Class Magistrate Court-I, Ettumanoor filed this petition praying for a direction to the learned Magistrate to consider and dispose of Exhibit P2 application for execution of Exhibit P1 order expeditiously.
2. In the light of the above prayer in this OP, a report was called for from the learned Magistrate about the reason for the delay in execution of Exhibit P1 order. As per report dated 24.11.2025, the learned Magistrate reported that though distress warrant was ordered against the counter petitioner as early as on 27.8.2022, no steps were taken by the petitioner herein for issuing distress warrant till date.
3. In the above circumstance, it is revealed that the delay in execution of Exhibit P1 order is due to the default of the petitioner himself and as such this OP is liable to be dismissed.
In the result, this OP is dismissed with liberty to the petitioner to proceed with the execution proceedings pending before the learned Magistrate.
