2025 Supreme(Online)(Ker) 56143

IN THE HIGH COURT OF KERALA AT ERNAKULAM
VIJU ABRAHAM, J
VIMALCHAND A.V – Appellant
Versus
VIDYA PRACHARANAM PRIVATE LIMITED – Respondent
WP(C) NO. 39616 OF 2025

Advocates:
For the Appellants/Petitioners: R.SURENDRAN
For the Respondents: P.G.CHANDAPILLAI ABRAHAM, ISAAC THOMAS, JOHN VITHAYATHIL

A writ petition was closed due to the petitioners pursuing alternate legal remedies before the National Company Law Tribunal.

Headnote:The writ petition sought two reliefs, one of which was granted by interim order. The second was for reasonable time to challenge the actions of the respondents before the National Company Law Tribunal, Kochi, as filed in Petition No.CP(C/ACT)/39/KOB/2025. Consequently, nothing remains in the writ petition and it is closed.

JUDGMENT

Two reliefs have been sought in this writ petition. One has already been granted by an interim order of this Court. The second relief is for the grant of a reasonable time, for the petitioners to approach the National Company Law Tribunal, Kochi Bench to challenge the actions of the respondents evidenced by Ext.P1. It is seen that the petitioners have already moved the National Company Law Tribunal, Kochi Bench, by filing Petition No.CP(C/ACT)/39/KOB/2025.

In the light of the above development, nothing survives in this writ petition and the same is accordingly closed.
