A criminal miscellaneous case becomes infructuous when the matter sought has already been resolved, resulting in no further proceedings needed.

Headnote:In the present case, the Petitioner filed a Crl.M.C seeking interim custody of the vehicle bearing registration No.KL-41-L-4961 and a direction for the consideration of a claim petition by the 1st respondent. The Petitioner's counsel reported that the vehicle had already been released. Therefore, the Crl.M.C was rendered infructuous. The court concluded that the Crl.M.C was closed as infructuous due to the vehicle's release.

O R D E R

This Crl.M.C is filed by the Petitioner seeking a direction to the 2nd respondent to grant interim custody of the vehicle bearing registration No.KL-41-L-4961 in favour of the Petitioner and further seeking a direction to the 1st respondent to consider Annexure-A3 claim petition and pass appropriate orders thereon in favour of the petitioner. 2. Today, when the case is taken up for consideration, the learned counsel for the Petitioner submits that the vehicle has already been released and hence, this Crl.M.C has become infructuous. In view of the said submission, this Crl.M.C is closed as infructuous.
