Dated this the 15th day of December, 2025 The writ petition is filed challenging Ext.P4 show cause notice issued by the 3rd respondent. The primary contention raised against Ext.P4 show cause notice is that the same has been issued without jurisdiction. According to the petitioner, the licensing authority is not empowered to issue a show cause notice in a case of this nature, since Section 19 of the Motor Vehicles Act provides for suspension of a driving licence only in certain specified cases. Rule 21 of the Central Motor Vehicles Rules also prescribes the specific circumstances under which the licensing authority or the additional licensing authority can invoke its jurisdiction to suspend or disqualify a person from holding or using a driving licence.

It is the contention of the petitioner that none of the provisions under Section 19 of the Motor Vehicles Act or Rule 21 of the Central Motor Vehicles Rules were taken into consideration by the licensing authority while issuing the show cause notice, as the charges levelled against the petitioner do not fall within the purview of the said provisions.
