IN THE HIGH COURT OF KERALA AT ERNAKULAM
P.M. Manoj, J
K C Chacko – Appellant
Versus
The Secretary Regional Transport Authority – Respondent
WP(C) NO. 46957 OF 2025
JUDGMENT
Dated this the 15th day of December, 2025 The writ petition has been filed seeking expeditious disposal of Form P.Tem.A, which is a temporary permit application submitted under Section 87 (1)(c) of the Motor Vehicles Act . According to the petitioner, he has applied for a temporary permit to operate a vehicle bearing registration No.KL-63/D-3541 on the route Kottayam–Vazhavara, considering the travel requirements of the public residing in the ill severed areas along the route.
2. It is submitted by the learned counsel for the petitioner that the petitioner’s own vehicle bearing registration No. KL-05/AF-3060 was earlier operating on the said route with approved timings. In view of the ensuing Sabarimala season, Christmas holidays, and school examinations, and for the benefit of the travelling public and students, the petitioner submitted Ext.P1 application dated 02.12.2025, seeking a temporary permit and requesting its expeditious consideration.
3. However, on perusal of the pleadings, I do not find any supporting documents apart from the application under Rule 143(c) of the Kerala Motor Vehicles Rules, 1989 for the issuance of a temporary permit under Section 87 (1)(c) of the Act. Since the petitioner has confined his relief to the limited prayer for expeditious disposal of the said temporary permit application, I am of the considered opinion that the writ petition itself can be disposed of by issuing a direction to the respondent to consider and pass appropriate orders on the application in accordance with the provisions of the Motor Vehicles Act and the Rules framed thereunder.
4. Accordingly, there shall be a direction to the respondent to consider Ext.P1 application, if the same has been received and is pending, and if a settled timing is available with respect to the petitioner’s erstwhile vehicle bearing registration No.KL-05/AF-3060, within a period of one week from the date of receipt of a copy of this judgment.
The writ petition is accordingly disposed of.
