JUDGMENT
The Kerala State Electricity Board Ltd. and its officials challenge Ext.P5 order of the Kerala State Electricity Appellate Authority in an appeal preferred by the 2nd respondent, the consumer.
2. Both sides submit that the issue has been covered by this judgment of this Court in WP(C) No. 40116/2023 and connected cases, where a similar issue was directed to be reconsidered by the Appellate Authority.
Accordingly, this writ petition is allowed. Ext.P5 is set aside. There will be a direction to the 1st respondent – Appellate Authority to rehear Appeal No. 321/2023 and pass a speaking order as directed in the judgment referred above, with notice to the petitioner and the 2nd respondent. Orders shall be passed as directed above within three months from the date of receipt of a copy of this judgment. All the contentions of the parties are left open.
