The dismissal of a quashing petition reserves the right for the petitioner to challenge the final report or seek discharge before the appropriate court.

O R D E R

The Criminal Miscellaneous Case is filed to quash Annexure A1 FIR in Crime No.2468 of 2020 registered by the Karunagappally Police Station.

The learned Public Prosecutor, on instructions, submits that the Investigating officer has already laid the final report before the Court of the Judicial Magistrate of First Class-I, Karunagappally and the case has been numbered as C.C.No.880 of 2021.

In light of the above submission, the Crl.M.C. is dismissed, but by reserving the right of the petitioner to either challenge the final report or file an application for discharge before the jurisdictional court, provided the charge has not been framed yet.
