ORDER
Dated this the 10th day of December, 2025 The petitioner is the accused in Crime No.11/2020 registered by the Excise Range Office, Thalassery, alleging the commission of an offence punishable under Section 20 (b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (‘Act’, in short).
2. The petitioner was arrested on 25.08.2020 and was enlarged on bail on 28.10.2020 by the Court of the Special Judge (NDPS Act Cases), Vadakara (‘Trial Court’, in short). Subsequently, alleging that the petitioner got involved in Crime No.891/2021 registered by the Perambra Police Station, for the commission of the offences punishable under Sections 20 (b)(ii)(C), 25 and 29 of the Act, the Investigating Officer in the present crime filed C.M.P.No.233/2021 before the Trial Court to cancel the bail. By Annexure A1 order, the Trial Court has cancelled the bail granted to the petitioner in the present crime.
Annexure A1 order is erroneous and unjustifiable. Hence, the Crl.M.C.
3. I have heard the learned counsel for the petitioner and the learned Public Prosecutor.
4. The learned Public Prosecutor very fairly submits that the petitioner has already been acquitted in Crime No.891/2021
