ORDER

This bail application is filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short ‘ BNSS ’).

2. Petitioner is the first accused in Crime No.662 of 2025 of Varantharappilly Police Station, Thrissur, registered for the offences punishable under Sections 303 , 325 and 3(5) of the Bharatiya Nyaya Sanhita , 2023 as well as Section 25 (1-B)(a) and 3 of the Arms Act , 1959 and Section 11 (1)(i) of the Prevention of Cruelty to Animals Act , 1960.

The prosecution case is that on 17.11.2025, the Accused Nos.1 to 4 along with a child in conflict with law had in furtherance of their common intention, committed theft of a cow and butchered it using an illegal gun and transported the meat in the autorickshaw driven by the petitioner and thereby committed the offences alleged

4. Heard the learned counsel for the petitioner as well as the learned Public Prosecutor.

5. The learned counsel for the petitioner submitted that the petitioner has been in custody since 17.11.2025 and hence he ought to be released on bail.

6. The learned Public Prosecutor opposed the bail application.

7. Petitioner, along with four others had allegedly committed theft of a cow and butchered it and transported the meat in the autorikshaw driven by the petitioner.

8. Though the allegations are serious, considering the fact that the petitioner was the driver of the autorikshaw, I am of the view that continued detention of the petitioner is not warranted. Moreover the 2^nd accused is stated to have been granted bail by the Magistrate's Court Even though the learned Public Prosecutor pointed out that the petitioner is involved in six other crimes, since none of the offences in those crimes are similar in nature, I am of the view that those antecedents need not deter this Court from granting bail to the petitioner.

9. In the result, this application is allowed on the following conditions:-

(a) Petitioner shall be released on bail on him executing a bond for Rs.50,000/- (Rupees fifty thousand only) with two solvent sureties each for the like sum to the satisfaction of the court having jurisdiction.

(b) Petitioner shall appear before the Investigating Officer as and when required.

(c) Petitioner shall not intimidate or attempt to influence the witnesses; nor shall he tamper with the evidence.

(d) Petitioner shall not commit any similar offences while he is on bail.

(e) Petitioner shall not leave India without the permission of the Court having jurisdiction.
