IN THE HIGH COURT OF KERALA AT ERNAKULAM
DEVAN RAMACHANDRAN, M.B. SNEHALATHA, JJ
DEEPAK T.R – Appellant
Versus
ASHMA – Respondent
Devan Ramachandran , J.
The limited plea of the petitioner is that the learned Family Court, Attingal, be directed to dispose of Ext.P1 Original Petition, namely OP(H&M) No.135/2023, within a time frame to be fixed by this Court.
2. We called for a report from the learned Family Court, which is available. The learned Judge has informed us that the total pendency in the Court is 7616; and that, therefore, the Original Petition can be disposed of only within six months. It has further informed us that IA No.3/2025 - which is an application filed by the petitioner seeking speedy disposal of the Original Petition - will be considered and ordered within
22.12.2025.
3. We have no doubt that we cannot intervene in every case and direct Original Petitions to be disposed of in priority. The workload endured by every Family Court in Kerala is something that we cannot be oblivious to.
In the afore circumstances, and since we find full favour with the time frame suggested by the learned Court, we dispose of this Original Petition, directing the learned Family Court to dispose of the application and Original Petition within the time frame stated in its report.
