JUDGMENT
It is submitted by the learned counsel on both sides that the matter is settled between the parties by recourse to Section 89 of the Code of Civil Procedure, 1908 (for short, ‘CPC’), on a reference made by this Court on 26.11.2025.
2. The report submitted by the Mediator along with the memorandum of agreement is produced in RFA No.159 of 2021.
3. The appeal and cross objection are disposed of in the light of the said agreement. The memorandum of agreement shall form part of the judgment.
4. Since the matter has been settled by recourse to Section 89 of CPC, the court fee paid shall be refunded to both appellants and the cross objectors.
The Registry may refund the court fee on usual terms.
