ORDER

Dated this the 26th day of December, 2025 In this petition, petitioner who is the 1st accused in Crime No.18/2024 of Thana West Jodhpur Police Station, Jodhpur, Rajasthan has sought anticipatory bail under Section 482 of Bharatiya Nagarik Suraksha Sanhita , 2023 (for short ' BNSS '). When the matter came up for hearing, the learned counsel for the petitioner/A1 submitted that he is seeking only transit bail.

2. According to the petitioner, the offence alleged against the the petitioner are under Section 498A, 406 and 323 of IPC. It was further contended that he is innocent and if he is arrested and taken to Rajastan and detained, he would be put to irreparable injury and loss and therefore he seeks transit bail. It was further submitted that A2 and A3 in the above crime were already granted transit bail by this Court by order in B.A No.9717/2024.

3. It is a settled position that this Court can grant transit anticipatory bail for an FIR that is registered outside its territorial jurisdiction.

4.The petitioner apprehends interstate arrest and the petitioner has made out sufficient reason for his inability to seek anticipatory bail form the jurisdictional court.

5.Therefore, transit bail is granted to the petitioner upto 12.1.2026 and it would be upto the petitioner/A1 to approach the jurisdictional court to workout his remedies in accordance with law on or before 12.1.2026. In order to facilitate to workout his remedies, respondents 1 and 2 are directed to not to arrest the petitioner till 12.1.2026.

Without expressing any opinion on merits of the case and taking into account the limited scope of transit bail, this Court is of the view that petitioner/A1 deserves temporary protection to enable him to approach the jurisdictional court. Accordingly, he is granted transit bail upto 12.1.2026 subject to the following conditions:

i) In the event of arrest in connection with the above crime, he shall be released on bail, on his executing a bond for Rs.1 lakh with two solvent sureties each for the like sum.

ii) He shall approach the competent court within the aforesaid period and seek appropriate bail.

iii) This order shall automatically stand cancelled after the expiry of the aforesaid period.

This bail application is disposed of accordingly.
