JUDGMENT

Dated this the 18^th day of December, 2025 Syam Kumar V.M., J This Writ Appeal is filed challenging the judgment of the learned Single Judge dated 07.01.2019 rendered in W.P.(C)

No.35138 of 2009. Appellant was the petitioner in the W.P.(C). 2. Appellant had filed the W.P.(C) challenging Ext.P26 decision of the Government whereby the proposal to promote him as Chief Engineer of Thiruvananthapuram Development Authority (TRIDA) had been declined. He contended that such denial of his promotion was illegal, arbitrary, and filed the W.P.(C) seeking the following reliefs:

“(i) a writ of certiorari or other appropriate writ, direction or order quashing Exhibit.P26 as illegal, arbitrary, and irrational.

(ii) a writ of mandamus or other appropriate writ, direction or order directing respondents 1 to 3 to effect promotion of the petitioner as Chief Engineer, Thiruvananthapuram Development Authority (TRIDA) forthwith in terms of the recommendations of the DPC.

(iii) a declaration that the petitioner is entitled to be promoted as Chief Engineer, Thiruvananthapuram Development Authority (TRIDA) with effect from the date of occurrence of vacancy viz, the date of eligibility accrued on 19.03.2
