Service matters, including pension disputes, must be addressed before the competent Tribunal as per the Administrative Tribunals Act.

Headnote:The court noted that the petitioner, a retired government employee, sought to quash a letter pertaining to pension arrears and sought reliefs including full payment and interest as per Ext.P2. However, the court held that due to the nature of the grievances related to service matters, the competent Tribunal should be approached according to Section 15 of the Administrative Tribunals Act, 1985. Hence, the writ petition was dismissed with the liberty granted to approach the Tribunal.

JUDGMENT

Dated this the 16th day of December, 2025 The petitioner, who has retired from the Educational Department of the Government of Kerala, has filed this writ petition seeking the following reliefs:

“i) To call for the records leading to Ext.P3 letter and to quash them by issuing a writ of certiorari.

ii) To issue a writ of mandamus or any other appropriate writ, order or direction commanding the respondents to release the full pension arrears along with dearness relief and all other admissible dues for the said periods as stated in Ext.P2.

iii) To issue a writ of mandamus or any other appropriate writ, order or direction commanding the respondents to pay interest on the arrears @ 12% per annum or any other reasonable rate this Hon’ble Court decides from the date of accrual till actual payment.”

2. As the petitioner is a retired State Government employee, for any relief relating to service matter including pension, the petitioner has to approach the competent Tribunal under Section 15 of the Administrative Tribunals Act , 1985.

The writ petition is accordingly dismissed as withdrawn granting liberty to the petitioner to approach the competent Tribunal.
