This Original petition filed by the petitioner/defendant for issuing direction to the Munsiff’s Court-IV, Thiruvananthapuram, for speedy disposal of O.S.No.1675/2023 within a time-bound manner.
2. A report has been sought from the concerned court, where the trial Court stated as under:-
“O.S.No.1675/2023 on the file of this Court was instituted by Sri.A.Mohanan Nair against Smt.Sruthi Sreekumar for seeking mandatory and prohibitory injunction and other reliefs. On issuance of summons the defendant entered appearance through Power of Attorney and filed written statement. After that, the matter was referred to mediation but the matter was not settled. Issues were settled. Now the case stands posted for pre-trial steps. The report is humbly submitted for kind consideration.
I may submit that at present there are 5-time limit matters and 345 5+ year old matters (OS-278, EP-61 and SOP-1), pending before this Court. Moreover, special drive is also being conducted for the disposal of execution cases (304 cases) within six months, as directed by the Hon'ble High Court of Kerala and the Hon'ble Apex Court.
Considering the above circumstances, I may humbly sub- mit that a period of three months time may kindly be granted for the disposal of the above case, after comple- tion of all necessary steps. I may further submit that earnest efforts will be made by me for the early disposal of the case. This is humbly submitted for the kind consid-
eration and favourable action.”
3. On perusal of the report, it reveals that the court has a large number of old matters and some direction matters to be dis- posed of, apart from that 304 cases required to be disposed of within six months as per the directions of the High Court of Ker- ala. The court states that it will make an endeavour to dispose of the matter as early as possible.
4. Considering the facts and circumstances of the case and the report of the concerned court, this Original Petition is disposed of with a direction to the concerned court to dispose of O.S.No.1675/2023 within 12 months from the date of completion of the pre-trial steps.
