IN THE HIGH COURT OF KERALA AT ERNAKULAM
N.NAGARESH, J
FAISAL V P – Appellant
Versus
STATE OF KERALA – Respondent
WP(C) NO. 30939 OF 2025
For the Appellants/Petitioners: SRI.POOVAMULLE PARAMBIL ABDULKAREEM
For the Respondents: SMT.SONY K.B.,GOVERNMENT PLEADER
The Court upheld the principle of automatic post upgradation in cases of increased workload, irrespective of financial implications.
Headnote:The petitioner, serving as HSST (Junior), sought upgradation of their post based on increased workload. The rejection of the request due to potential financial burden on the government was contested. The Court reaffirmed existing rulings that dictate automatic upgradation when workload exceeds 15 hours. The petition was thus ordered to be reconsidered without financial considerations. The matter is directed to be revisited within two months.

| 1. upgradation of educational posts based on workload. (Para 1 , 2) |
JUDGMENT
Dated this the 9th day of January, 2026 The petitioner is working as HSST (Junior). According to the petitioner, there is sufficient workload in the School, which would entitle the School to upgrade the post of HSST (Junior) as HSST (Arabic). However, the request made by the Manager stands rejected as per Ext.P9 communication dated 24.04.2025 on the ground that upgradation of the post would result in a financial burden on the Government. As the Institution is an aided Institution imparting education to children, the financial burden cannot be an excuse to upgrade an existing post in the School.
2. This Court has held in Ext.P10 judgment that if the workload is increased beyond 15 hours, the upgradation should be granted automatically. A similar view was taken in W.P.(C) No.43850/2024 also.
Therefore, following the judgment in W.P.(C) No.43850/2024, this writ petition is disposed of directing the 3rd respondent to reconsider the claim of the School for upgradation of the post of HSST (Junior) (Arabic), untrammeled by any of the observations in Ext.P9. A decision afresh shall be taken within a period of two months.
