JUDGMENT

1. The present Original Petition under Article 227 of the Constitution of India assails the interim order dated 06.01.2026 passed in Original Application No. 180/00001/2026 by the Central Administrative Tribunal, Ernakulam Bench, whereby the stay granted earlier has been vacated.

2. The petitioner is presently working as a Co-operative Inspector (also Secretary, Lakshadweep Co-operative Marketing Federation), posted at Beypore. Being aggrieved by the order of transfer from Beypore in Kozhikode District to Amini Islands in the Union Territory of Lakshadweep, the petitioner filed the Original Application. Initially, the Tribunal granted an interim order; however, by the impugned interim order dated 06.01.2026, the said interim order was vacated. The Tribunal vacated the interim order on the grounds that the petitioner has been allotted a quarter at Ernakulam and that his child is studying in KVS, Ernakulam. Earlier, the petitioner was transferred to Lakshadweep in the year 2023, which was challenged in O.A. No. 102/2023, and the said Original Application was allowed.
