This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, BNSS ), seeking regular bail.
2. The applicant is the sole accused in Crime No.15/2025 of Ernakulam Town North Police Station, Ernakulam District. The offence alleged is punishable under Section 64 (1) of the Bharatiya Nyaya Sanhita, 2023 (for short ‘ BNS ’).
3. The prosecution case, in short, is that the applicant, with the intention to rape the first informant, gave a promise of marriage to her whom he got acquainted with through social media. The applicant took the first informant to a room in Vedanta Hotel and then committed rape on her between 09.00 p.m. on 12.12.2024 and 05.30 a.m. on 13.12.2024. Thereafter, the accused withdrew from his promise to marry the first informant. Therefore, it is alleged that the applicant has committed the aforesaid offence.
