Headnote:This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking pre-arrest bail for the applicant in Crime No.901/2025 of Anthikad Police Station, Thrissur. The offences alleged are under Sections 329(3), 326(f), and 324(5) of the Bharatiya Nyaya Sanhita, 2023, which are bailable in nature. The court found the apprehension of arrest to be ill-founded and dismissed the bail application. The court specified that if non-bailable offences arise during the investigation, proper notice will be issued. The bail application is dismissed.

ORDER

This application is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita , 2023 (for short, BNSS ), seeking pre-arrest bail by the applicant/accused in Crime No.901/2025 of Anthikad Police Station, Thrissur.

The offences alleged against the applicant are punishable under Section 329 (3), 326(f) and 324(5) of the Bharatiya Nyaya Sanhita, 2023 which are bailable in nature. Hence, the apprehension of arrest is ill-founded. Accordingly, this bail application is dismissed. However, during investigation, if any non bailable offence is incorporated, the applicant shall be issued with notice under Section 35 (3) of the Bharatiya Nagarik Suraksha Sanhita , 2023.
