JUDGMENT

This appeal is filed by the claimant in OP(MV) No.618 of

2007 on the file of the Motor Accidents Claims Tribunal, Kottayam, claiming enhancement of compensation. The respondents herein are the respondents before the tribunal.

2. According to the claimant, on 16.10.2006 at about

12.30 p.m., while the claimant was travelling in a car bearing registration No.KA-01-MR-2727, driven by the 2^nd respondent, in a rash and negligent manner from Pala to Erattupetta, another lorry bearing registration No.KL-1P-6145 also driven by the first respondent in a rash and negligent manner collided with the car, thereby the claimant sustained serious injuries. The claimant approached the tribunal claiming a total compensation of ₹3,00,000/-.

Though notice was served on respondents 1 to 4, the drivers of the lorry and the car and the owners of the lorry and the car respectively, they remained absent and were set ex parte before the tribunal. The fifth respondent insurer of the lorry, filed a written statement, admitting the insurance policy and disputing the liability and quantum of compensation claimed.
