Dated this the 14th day of January, 2026 ORDER The Criminal Miscellaneous Case is filed assailing Annexure-1 order passed by the Court of Session, Kozhikode (Appellate Court) in CMP No.2506/2023 in Crl.A.No.320/2023 directing the petitioner to deposit 20% of the fine amount within 60 days for the purpose of suspending the execution of substantive sentence and fine.

2. When the Criminal Miscellaneous Case came up for consideration on 16.02.2024, this Court had directed the petitioner to deposit 10% of the fine amount within 30 days from the date of order.

3. The learned Counsel for the petitioner as well as the learned Counsel for the 2nd respondent submit that the petitioner has already deposited 10% of the fine amount as directed by this Court.

In light of the above submission, the Criminal Miscellaneous Case is disposed of, by modifying the impugned order and confining it to the interim order dated 16.02.2024, and directing the Appellate Court to consider and dispose of Crl.A.No.320/2023, in accordance with law and as expeditiously as possible.
