J U D G M E N T
Dated this the 15th day of January, 2026 The short grievance of the petitioner is that the petitioner's application for effecting transfer of registry has been refused on account of the pendency of an attachment in A.R.C.No.1/2017 filed by the 4th respondent/Co-operative Bank. The petitioner claims title under sale deed no.548/2021 of the S.R.O., Kothiyathod. Petitioner stands in need of obtaining land tax receipt, for which, he applied for transfer of registry. However, the same is refused for the reason cited above.
2. Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court notice that the mutation cannot be refused for the reason of there being an attachment by a court of law. The issue has been settled by a Full Bench decision of this Court in Fathima v. Canara Bank [1925 (3) KLT 367]. In the circumstances, there will be a direction to the 2nd respondent/Tahsildar to effect transfer of registry in favour of the petitioner if his application is otherwise in
