The petitioners singularly seek that the learned Family Court, Attingal, be directed to dispose of Ext.P4 application ― namely IA No.7/2023 in OP No.528/2022 ― wherein, they have raised the question of maintainability of the said Original Petition, within a time frame to be fixed by this Court.
2. We do not propose to intervene at this stage for the singular reason that Ext.P4 is filed in the year 2023; while, the Original Petition has been pending for over three and half years now.
3. We have no reason to believe that the learned Family Court will not consider Ext.P4 appropriately, particularly when we understand that the Original Petition may be nearing disposal.
In the afore circumstances, though we do not accede to the plea of the petitioners, we direct the learned Family Court, Attingal, to ensure that Ext.P4 application ― if it is still pending ― is considered properly, either along with, or before the Original Petition is finally disposed of.
