ORDER
Dated this the 15th day of January, 2026 This is a petition filed under Section 528 of B.N.S.S. , by the victim and her parents in Crime No. 277 of 2025 of Harbour Police Station praying for quashing the proceedings against the accused. The offences alleged against the 2nd respondent/accused are under Sections 7 , 8 and 9 of the Protection of Children from Sexual offences Act (POCSO Act).
2. The prosecution case is that the 2nd respondent/accused, who was the teacher of the victim minor girl, while she was studying in the 4th standard, placed the child on his lap and touched the nose and cheeks of the child and thereby he is alleged to have committed the aforesaid offences.
3. According to the petitioners/defacto complainant, the dispute has been amicably settled with the 2nd respondent/accused. Therefore, they prayed for quashing all further proceedings against him.
4. The petitioners/defacto complainant filed affidavits endorsing the averments in the Criminal MC. According to them, the dispute has been amicably settled and that they do not intend to proceed with the case and also that further proceedings in the case can be quashed.
