JUDGMENT
This writ petition is filed with the following prayers:-
(i) call for records leading to Ext.P5 order and issue a writ of certiorari quashing the same.
(ii) issue writ of mandamus or other appropriate writ or order directing the 3rd respondent to reconsider Ext.P4 application and pass orders on the same within stipulated time limits, in the interest of justice.
2. The petitioner is a senior citizen aged 66 years residing with his wife in the residential property in Valappad village. The 4th respondent is the son of the petitioner. Since the 4th respondent was taking care of the petitioner and his wife and was not providing maintenance, Ext.P1 complaint was filed by the petitioner before the police authorities. Thereafter, the petitioner filed Ext.P4 complaint before the Maintenance Tribunal for directing the 4th respondent to provide an amount of ₹10,000/- towards maintenance to the petitioner. However, as per Ext.P5 order, the Tribunal directed the 4th respondent to take care of the petitioner and to arrange a separate room in the petitioner’s house to ensure his peaceful living.
