JUDGMENT
(Dated this the 16th day of January, 2026)
The petitioner has availed a housing loan from the respondent Bank by offering security. Upon default, a notice was issued under Section 13 of the SARFAESI Act demanding an amount of Rs.6,42,666.88/-, followed by a notice under Section 13 (4). The petitioner prays that he may be granted 24 installments to pay the overdue amount.
2. The learned counsel for the respondent, on instructions, submits that apart from the home loan, four credit cards were issued to the petitioner and that there are overdues in three of the credit card accounts, which amount to Rs.3,98,300/-. Though there is no overdue in the home loan account as of now, unless the overdue amounts in the three credit card accounts are cleared, the loan account cannot be regularised.
3. The learned counsel for the petitioner seeks fifteen installments to pay the outstanding amount of the three credit cards, which is opposed by the learned counsel for the respondent.
