IN THE HIGH COURT OF KERALA AT ERNAKULAM
P.V. KUNHIKRISHNAN, J
ANOOP RAWTHER – Appellant
Versus
THE DISTRICT COLLECTOR – Respondent
WP(C) NO. 25627 OF 2025

Advocates:
For the Appellants/Petitioners: SHRI.NAHAS H.
For the Respondents: SMT. PREETHA K K

The court mandates timely consideration of appeals against interim orders to ensure expediency in administrative proceedings.

Headnote:The petitioner filed a writ petition seeking relief against an interim order (Ext.P5) issued by the District Collector. The court determined the need for expeditious consideration of the pending appeal. The court ordered the Collector to hear the petitioner within six weeks while maintaining the status quo. The final ruling requires the Collector to proceed within the stipulated timeframe.

JUDGMENT

This writ petition is filed seeking the following reliefs:

“i)To issue a writ of certiorari or such other appropriate writ, order or direction quashing Ext. P5 stop memo issued by the 1st respondent.

ii)To dispense with the production of the translation of vernacular documents.

iii) To issue such other writ, order or direction as this Hon’ble Court may deem fit and proper in the circumstances of the case.”[SIC]

2. The petitioner is challenging Ext.P5 stop memo issued by the 1st respondent.

3. This Court perused Ext.P5. Ext.P5 is only an interim order passed in a pending appeal. This Writ Petition is pending before this Court from 10.07.2025 onwards, and a status quo order was also passed by this Court. I am of the considered opinion that this Writ Petition need not be retained here. There can be a direction to the 1st respondent to complete the proceedings as evident from Ext.P5 within a time frame and till then the status quo order can continue on condition that the appeal is pending as on today.

Therefore, this Writ Petition is disposed of in the following manner:

1. The 1st respondent is directed to consider the appeal which leads to Ext.P5 interim order, if the appeal is pending as on today, after giving an opportunity of hearing to the petitioner, as expeditiously as possible, at any rate, within a period of six weeks from the date of receipt of a certified copy of this judgment.

2. Till final orders are passed as directed above, the status quo as on today will continue.
