ORDER
This application is filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, BNSS ) seeking regular bail.
2. The applicants are the accused Nos.1 to 3 in Crime No.1438/2025 of Kunnamkulam Police Station, Thrissur District. The offences alleged are punishable under Sections 189 (2), 189(4), 191(3), 126(2), 118(1), 110 and 190 of the Bharatiya Nyaya Sanhita, 2023 .
3. The prosecution case, in short, is that the accused persons 1 to 5 with their common intention to commit riot during the festival at Pulinchodu Kothodu temple, threw soda bottles against ladies and children with an intention to make riot. As a result, one child named Charan sustained injuries. The applicant No.1 voluntarily caused hurt to Akshay, who was present there with a stick, when the defacto complainant tried to prevent the act of the accused, the applicant No.1 threw a soda bottle at the head of the defacto complainant and he sustained injuries at his ear. If the defacto complainant had not evaded the attack of applicant No.1 timely, it could have resulted in his death and thereby committed the above offences.
