JUDGMENT
When this matter is taken up for consideration at 3.00 P.M., it was submitted by the learned Senior Government Pleader that there is adequate access to the temple, as claimed by the petitioner.
2. This Court notice that the necessity for issuance of a permanent magazine has been discussed in the judgment in W.P. (C)No.2012/2026 and had been dispensed with. The second issue highlighted in the impugned Ext.P10 Order is the one with respect to the access, which also stands settled by virtue of the submissions made by the learned Government Pleader.
3. In this circumstances, the 3rd respondent is directed to issue necessary permission to the petitioner for display of fireworks, subject to the following conditions:-
i. The petitioner shall be permitted to carry out fireworks display on 30.01.2026 at 9.00 P.M. using the same number of fireworks as mentioned in Ext.P1 application.
ii. Since no magazine/store room is maintained, the authorities shall ensure that the fireworks is carried out only with help of the portable magazine, which is brought in at the time of fireworks.
