O R D E R Dated this the 28th day of January 2026 The petitioner is the accused in C.C No.1043/2019 on the file of the Court of the Special Additional Chief Judicial Magistrate (for the trial of criminal cases against sitting and former MPs/MLAs of the State) Ernakulam ( Trial Court).

2. The Criminal Miscellaneous Case is filed to quash Annexure A1 complaint filed by the 2nd respondent alleging the commission of the offence punishable under Section 138 of the Negotiable Instruments Act , 1881.

3. When the Crl.M.C came up for consideration

15.12.2025, this Court had called for a report from the Trial Court to ascertain the status of the above case.

4. By communication dated 07.01.2026, the Trial Court has reported that the case was posted for complainant’s evidence on 29.09.2023. However, on the said date, the complainant filed an application for withdrawal of the complaint, the same was allowed and the accused has been acquitted under Section 257 of the Cr. P.C.

In light of the above communication, the Crl.M.C is dismissed as infructuous.
